PRIVACY POLICY

  • Introduction
  • Calmies, LLC (“Company,” “we” or “us”) offers Calmies brand of natural baby products for direct sale to consumers on its website, www.calmies.com (“Calmies Website”).  This privacy notice aims to inform you about how we collect, use, disclose and store information about you when you use various features on the Calmies Website.  We also try to make it as simple as possible for you to control the information you share through the Calmies Website – whether such information is kept private, becomes publicly available by search engine index, is shared with some of our third-party service providers or gets permanently deleted.

  • What Information Do We Collect Through The Calmies Website?
  • We only collect information about users of the Calmies Website if we have a reason to do so.  For example, we collect information that is necessary to process your purchases, to ship the products you purchased from us, to communicate with you about our products and services, or to improve our services to you.  

    Consequently, we collect information from the three following sources:  

    (1) Information you provide to us; 

    (2) Information we collect automatically through cookies; and 

    (3) Information collected from third parties such as service providers we use or through social networking sites.

  • Information Users Directly Submitted to Us:
    • If you contact us through the Calmies Website, we will keep a record of our correspondence.

    We gather various types of information, including information that identifies or may identify you as an individual (“Personal Information”).  We collect Personal Information, such as name and email address when you set up an account on the Calmies Website or subscribe to our newsletter.

  • Personal Information from Purchase Transactions:
  • If you have purchased products through the Calmies webstore and have provided information necessary to ship the purchased products to you, then we would have received and stored your Personal Information such as names, usernames, email addresses, postal addresses, phone numbers and payment information.  

    • Other Information: In addition to Personal Information, if you have uploaded other information by submitting correspondence through the Calmies Website, we will maintain such information.  
  • Information We Collect Automatically:
  • (a) Information Collected Through Cookies And Other Similar TechnologiesWhen you visit the Site, we automatically collect certain information about your device, including information about your web browser, IP address, time zone, and some of the cookies that are installed on your device. Additionally, as you browse the Site, we collect information about the individual web pages or products that you view, what websites or search terms referred you to the Site, and information about how you interact with the Site. We refer to this automatically-collected information as “Device Information”. 

    We collect Device Information using the following technologies:

    - “Log files” track actions occurring on the Site, and collect data including your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps. 
    - “Web beacons”, “tags”, and “pixels” are electronic files used to record information about how you browse the Site. 

    Through use of cookies and similar technologies that are set on the Calmies Website, we collect the following information:

    • Usage information:  We keep track of activities on the Calmies Website from users, how users interact with the website and our website’s performance.
    • Log information:  We log information about our visitors use of the Calmies Website.  The log information includes collection of Internet Protocol (“IP”) addresses from users.  
    1. Information We Collect About You from Third Parties:

    Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.  Furthermore, shipping services provided by USPS and FedEx/DHL may provide us with updated or corrected delivery addresses for customer purchases.  


    In addition, if you log in to the Calmies Website through your Facebook account or have linked your Calmies account with your Google or Facebook accounts, Company may receive information from that service (such as your username and friends list, etc.) as a result of the authorization procedures for that service.  These are just some examples of many ways that your Personal Information may automatically be transmitted to us by third parties over the Internet.  


  • How We Use and Share The Information Collected Through The Calmies Website  
    1. How Company Uses Your Information:  

    We may use the information collected from visitors to our website for a variety of purposes, including to:

    1. Set up a user account;
    2. Process and complete purchase transactions;
    3. Provide, operate and maintain webstore services;
    4. Respond to inquiries and comments and provide customer service and support;
    5. Send alerts and security notifications; and 
    6. Investigate and prevent fraudulent activities such as unauthorized access to the Calmies Website.  
    1. Third Parties With Whom We May Share Your Information

    We may share your information with third party vendors, consultants and other service providers who perform necessary services for the Calmies webstore.  

    We use your Personal Information to provide you with targeted advertisements or marketing communications we believe may be of interest to you.     Company does not sell personal information collected through the Calmies Website in exchange for any monetary consideration.  However, if we were to share your personal information with third parties (through the use of cookies and similar technologies) that provide useful services which are not considered “essential,” such sharing could be deemed a “sale,” as defined by the California Consumer Privacy Act (Cal. Civ. Code 1798.140(t)(1)).  This includes sharing identifiers, commercial information and Internet or other electronic network activity with website analytics companies such as Google and Facebook that provide pixel tools which help us provide the kinds of products and marketing on our website that our customers want to see on the Calmies Website.  

    1. Third Parties’ Cookies, Technologies and Privacy Policies

    The third parties that provide necessary services for the Calmies webstore set cookies and similar technologies on the Calmies Website.  Consequently, interacting with third party software means that you are providing information about yourself to those third parties.  For example, some third-party services may request or require access to your data via cookie/pixel.  Please note that if you use a third-party’s service or grant access, your data will be handled in accordance with that third party’s privacy policies and practices.  

    Finally, we may also share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

  • Security
  • Presently, there is no company or service can guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.  However, we take reasonable measures to protect information about you.  If you have opened an account with us, your account is protected by a password for your privacy and security.  You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

  • Your Rights Regarding Your Personal Information
  • You can exercise your rights regarding your Personal Information collected through the Calmies Website easily in several ways:

  • As of the date of this Privacy Notice (“Notice”) we do not offer any products of services outside of the U.S.  Even so, in the event that any resident of the European Union has submitted his or her Personal Information through our website where such information was captured and shared with third parties through cookies or similar technologies used on the Calmies Website, we have provided options below to access, review, update, rectify, and delete any Personal Information we hold about you, or exercise any other right available to you under the EU General Data Protection Regulation (GDPR).

Forget me/Opt-out Form: To request that we delete all the information we collected about you through the Calmies Website please complete and submit the form available here https://Calmies.com.  Please note that we may still use any aggregated and de-identified Personal Information that does not identify any individual and may also retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.
    2. Review/Access Your Personal Information:  To request access to any Personal Information we have retained or collected about you, please send the request to: info@calmies.com.   
    3. To Opt-Out of Cookies: With respect to cookies, you can customize your settings at any time by clicking on the “inspector” icon which appears on the lower right corner of each webpage on the Calmies Website:   

    When you click on the “inspector” icon, it opens a "Privacy Settings" dialog box.  The categories of cookies the Calmies Website typically deploys during a browsing session are listed on the left side of the box.  The Privacy Settings box provides you with the option to allow or disable cookies under each category.

  • California Residents
  • California residents have specific rights under the California Consumer Privacy Act (‘CCPA’).  As of the date of this Privacy Notice (“Notice”), Calmies is not obligated to comply with the CCPA with respect to its Calmies Website.  However, we support the CCPA and have provided the following means to exercise control over your Personal Information we have collected:   

    • Delete Your Information:  If you would like to exercise your right to delete any Personal Information we have collected or received about you, please fill out the request form available through this link https://Calmies.com.
    • To Opt-Out:  Company does not sell Personal Information collected through the Calmies Website in exchange for any monetary consideration.  However, if we were to share your Personal Information with third parties (through the use of cookies and/or similar technologies), you can opt-out of the use of cookies by clicking on the "inspector" icon which appears on the lower right corner of each webpage on the Calmies Website.  

    This brings up a “Privacy Settings” dialog box.  The categories of cookies the Calmies Website typically deploys during a browsing session are listed on the left side of the box.  The Privacy Settings box provides you with the option to allow or disable cookies under each category.  Illustrations of the “inspector” icon and the Privacy Settings dialogue box are provided above in Section V, Paragraph 1, sub-paragraph d.

California and Delaware “Do Not Track” Disclosures:  California and Delaware law require the Company to indicate whether it honors “Do Not Track” settings in your browser concerning targeted advertising.  Company adheres to the standards set out in this Privacy Notice and does not monitor or respond to Do Not Track browser requests.
    2. The Right to Non-Discrimination:  Company will not discriminate against you (such as by denying goods or providing a different level or quality of goods or services) for exercising any of the rights available to you.
    3. Children:  We do not knowingly collect or solicit personal information from anyone under the age of 13.  If you are under 13, please do not attempt to set up an account on the Calmies Website or send any Personal Information about yourself to us.  If we discover that we have collected Personal Information from a child under age 13, we will delete that information as quickly as possible.  If you believe that a child under 13 may have provided us Personal Information, please contact us at info@calmies.com.
    4. Linked Websites: For your convenience, we have provided some hyperlinks to other websites (the “Linked Sites”) in this Notice in Section III, Paragraph 3, sub-paragraphs 1) through 5).  This Notice does not apply to, and we are not responsible for, the privacy practices of any Linked Sites or of any companies that we do not own or control.  Linked Sites may collect information in addition to that which we collect on the Calmies Website.  We do not endorse any of these Linked Sites, the services or products described or offered on such Linked Sites.  We encourage you to seek out and read the privacy notice of each Linked Site.  
    5. Changes to the Privacy Notice: We’re constantly trying to improve our Websites and Services, so we may need to change this Privacy Notice from time to time as well.  We will alert you to material changes by, for example, placing a notice on our Websites and/or by sending you an email (if you have registered your e-mail details with us) when we are required to do so by applicable law.  You can see when this Privacy Notice was last updated by checking the date at the top of this page.  You are responsible for periodically reviewing this Privacy Notice.
